The jurisdiction of this court was originally under Taiwan High Court Tainan Branch Court. Since the Kaohsiung city was upgraded from a provincial city to municipality on 1 July 1979, the number of cases surged. Those cases still had to be appealed and interlocutory appealed at Taiwan High Court Tainan Branch court. While conducting procedure in the second instance, people in the southern end of the Hengchun Peninsula in Pingtung County had to travel all the way to Tainan city, and the north-south is more than 100 kilometers which caused serious inconvenience. Thus, the Kaohsiung Provisional City Council recommended that a second-instance court should be set up in Kaohsiung City.


The building land for the building of this court and the prosecutors’ office was approved by Taiwan High Court and Taiwan High Prosecutors Office. The Longhua Section of the Gushan District in Kaohsiung City was selected in the plan. The acquisition and allocation of the building land was completed in 1985, and the construction began on November 20 of the same year. Taiwan High Court Kaohsiung Branch Court and Prosecutors Office was formally established on February 1, 1990. On the same day, the joint office building was opened, and cases began to be accepted on May 1 of the same year.
